A visitor visa is a strict contract. You are granted entry on the absolute condition that you leave on or before the expiry date stamped on your passport (or logged in your digital eVisa).
If you are traveling from India, failing to respect this date has devastating legal implications. Here is the 2026 guide to exactly what happens when you overstay in the top global destinations.
1. The Global “Five Eyes” Trap
Before looking at individual countries, you must understand Data Sharing. The US, UK, Canada, Australia, and New Zealand form the “Five Eyes” intelligence alliance. If you overstay your visa in Canada and are deported, the USA and the UK will know about it instantly.
The Consequence: An overstay in one Western country almost guarantees visa refusals from the others for the rest of your life.
2. USA: “Unlawful Presence” & The 10-Year Ban
The United States has the most rigid, mathematically strict overstay penalties in the world. Once your I-94 record expires, you begin accruing “Unlawful Presence.”
Under 180 Days: Your current visa is immediately voided. You will find it nearly impossible to get a B1/B2 visa approved again.
180 Days to 1 Year: If you overstay by more than 6 months but less than a year, and then leave, you trigger an automatic 3-Year Ban from re-entering the US.
More than 1 Year: You trigger a mandatory 10-Year Ban.
3. UK: Criminal Offence & The “Hostile Environment”
The UK Home Office does not treat overstaying as a simple administrative error. Under Section 24 of the Immigration Act, overstaying without a “good reason” is a criminal offence.
The 30-Day Rule: If you leave voluntarily at your own expense within 30 days of your visa expiring, you might avoid a formal re-entry ban, but the overstay will still heavily count against future applications.
The Bans: If you are deported at the UK government’s expense, or if you overstay long-term, you face bans ranging from 1 year to 10 years.
Loss of Rights: The moment your visa expires, you lose the right to rent property or use the NHS (except for life-saving emergencies). You will be charged 150% of the standard rate for any medical treatment received.
“My flight is cheaper if I leave 3 days after my visa expires. I’ll just pay a fine at the airport, right?” Wrong.
In 2026, an overstay of even a single day transitions you from a “Legal Visitor” to an “Illegal Immigrant.” You will not just pay a fine; you will trigger automatic entry bans and permanently destroy your chances of getting future visas for the US, UK, Canada, and Europe.
4. Schengen Area: The New 2026 “Auto-Ban” (EES)
In the past, some travelers got away with overstaying in Europe because border guards didn’t check passport stamps carefully. That loophole is closed.
The EES System: As of 2026, the digital Entry/Exit System (EES) automatically calculates your “90 days out of 180” allowance.
The Penalty: If you overstay by even one day, the system automatically flags you as an “Overstayer” across all 29 member states. You will face immediate administrative fines at the airport, and your name will likely be added to the Schengen Information System (SIS), resulting in a 1 to 5-year ban from all of Europe.
5. Canada: The “90-Day Restoration” Window
Canada is slightly more forgiving, but only if you act fast.
The 90-Day Grace: If your status expires, you have exactly 90 days to apply to IRCC for a “Restoration of Status.” You must pay a hefty fee and provide a brilliant reason for why you missed the deadline.
The Exclusion Order: If you do not restore your status and are caught, the CBSA (Border Services) will issue an Exclusion Order, banning you from Canada for 1 year. If you are deported for severe non-compliance, it becomes a permanent ban until you obtain an ARC (Authorization to Return to Canada).
6. What If You Have a Genuine Emergency?
If you are in a hospital bed or your flight is cancelled due to a natural disaster, do not just sit there and let your visa expire.
You must contact the immigration authorities before your visa expires.
Submit a formal application for an extension (or “Exceptional Assurance” in the UK) with heavy medical or airline documentation. As long as a valid application is processing, your status is legally protected.
