Receiving a rejection letter is devastating. You see the checkbox marked “Section 21: Doubts regarding the purpose of stay,” and you feel like your career is over.
Old advice says: “Just write an appeal letter!” As Visa Refusal Experts, we are here to tell you: That advice is outdated. In 2026, you need a new strategy.
Here is the breakdown of your actual options to overturn a rejection.
Option 1: The Administrative Court Lawsuit (Klage)
If the Embassy removed the Remonstrance option, your only legal appeal is to sue the Foreign Office at the Berlin Administrative Court (Verwaltungsgericht Berlin).
The Cost: You will need a German lawyer (€2,000 – €5,000).
The Timeline: 12 to 18 months.
The Verdict: Unless you have unlimited time and money, this is usually a bad idea for students. By the time you win, your university admission will have expired.
Option 2: The “Strategic Re-Application” (The Expert’s Choice)
This is the fastest way to fix a rejection. But you cannot just submit the same file again. Insanity is doing the same thing twice and expecting a different result.
If you were rejected under Section 21, the officer didn’t believe your story. To win a re-application, you must:
1. Deconstruct the Rejection: Analyze exactly why they doubted you. Was it the SOP? The finances? The interview?
2. Add New Evidence: You need “Fresh Facts.” Did you get a better IELTS score? Did you pay more tuition fees? Did you get a new internship certificate?
3. Rewrite the SOP: Your Statement of Purpose must explicitly address the previous rejection. “I understand my previous application was rejected due to X. I am now submitting Y to clarify…”

Has the “Remonstrance” been abolished?
For many years, you could write a free appeal letter (Remonstrance) to the Embassy if your visa was rejected. This has changed. To speed up processing, the German Missions in India (and many other countries) have largely eliminated the Remonstrance procedure for Student and Job Seeker visas. Your rejection letter now likely offers only two options: File a Lawsuit in Berlin or Re-Apply.
The “Remonstrance” Exception
Note: In very specific cases (usually Short-Stay Visitor Visas or specific medical emergencies), the Embassy might still allow a Remonstrance. Check your rejection letter.
If the last page says “You may remonstrate in writing…”, you have 1 month to submit a letter.
If it says “You may file a lawsuit…”, the Remonstrance door is closed.
